Shipping Policy

This Shipping Policy governs all orders placed through Wellness Body Worx ("we," "us," "our"). By placing an order, you ("customer," "you," "your") acknowledge that you have read, understood, and agree to be bound by all terms outlined in this policy. If you do not agree with these terms, do not place an order.

1. Order Processing Time

• Orders are typically processed within 1-5 business days (Monday-Friday, excluding statutory holidays) after payment confirmation and fraud verification.
• Processing time is separate from shipping time and refers only to order preparation, packaging, and handoff to the carrier.
• We reserve the right to extend processing time due to:
  • Inventory shortages or supplier delays
  • Payment verification or fraud prevention measures
  • High order volumes (including seasonal periods)
  • Technical issues or system maintenance
  • Force majeure events or circumstances beyond our reasonable control
• No cancellations or modifications are guaranteed once an order enters processing. Contact us immediately if changes are needed, though we cannot guarantee accommodation.

2. Shipping Methods & Carriers

• Shipping methods and carriers are selected at our sole discretion based on destination, product type, availability, and cost-effectiveness.
• Estimated delivery times provided at checkout or via email are estimates only and are not guaranteed.
• We do not offer same-day, overnight, or guaranteed delivery unless explicitly stated and paid for at checkout.
• We are not liable for delays, failures, or issues caused by:
  • Shipping carriers (Canada Post, UPS, FedEx, Purolator, etc.)
  • Severe weather, natural disasters, or environmental conditions
  • Customs inspections, clearance delays, or rejections
  • Labour disputes, postal strikes, or service disruptions
  • Pandemics, government restrictions, or public health emergencies
  • Incorrect, incomplete, or undeliverable shipping addresses provided by the customer
  • Recipient unavailability or failure to retrieve packages

3. Shipping Fees

• Shipping fees are calculated at checkout based on destination, weight, and selected shipping method.
• All shipping fees are non-refundable, including in cases of:
  • Order cancellation (if shipping has commenced)
  • Product returns, exchanges, or refusals
  • Delivery delays or failed delivery attempts
  • Customer-caused address errors or undeliverable addresses
• Free shipping promotions, if offered, apply only to standard shipping within Canada unless otherwise stated. Expedited or international shipping may incur additional charges.

4. Duties, Taxes & Customs Fees

• All duties, taxes, brokerage fees, import charges, and customs fees are the sole responsibility of the customer.
• International customers are responsible for understanding and complying with their country's import laws and regulations.
• We are not responsible for orders delayed, seized, rejected, or destroyed by customs authorities.
• No refunds, replacements, or credits will be issued for orders affected by customs-related issues, including but not limited to:
  • Import restrictions or prohibitions
  • Unpaid duties or taxes
  • Regulatory non-compliance
  • Customer refusal to pay customs fees

5. International Shipping

• International shipping is offered to select countries at our discretion and may be suspended or restricted at any time without notice.
• Delivery times for international orders are estimates only and may extend significantly due to customs processing, carrier routing, or local postal delays.
• Wellness Body Worx assumes no responsibility for:
  • Customs delays, inspections, or seizures
  • Lost or delayed international shipments after handoff to the carrier
  • Compliance with destination country regulations
  • Currency conversion fees or international transaction charges
• Customers are responsible for ensuring products are legal and permissible for import in their country.

6. Shipping Address Accuracy

• Customers are solely responsible for providing accurate, complete, and deliverable shipping information at checkout.
• This includes correct street address, unit/suite number, city, province/state, postal/ZIP code, and contact phone number.
• We are not responsible for orders shipped to:
  • Incorrect, incomplete, or outdated addresses
  • P.O. Boxes where carrier restrictions apply
  • Addresses flagged as undeliverable by the carrier
• Orders shipped to an incorrect address due to customer error are not eligible for refunds, replacements, or reshipment at our expense.
• If a package is returned due to an incorrect address, we may offer reshipment at the customer's expense, minus any applicable restocking fees.

7. Risk of Loss & Title Transfer

• All risk of loss and title for purchased items pass to the customer upon delivery to the shipping carrier.
• Once an order is marked as "shipped" and a tracking number is provided, the shipment is considered fulfilled by Wellness Body Worx.
• Any loss, theft, damage, or delay that occurs during transit or after delivery is the responsibility of the customer and/or the shipping carrier.

8. Lost, Stolen, or Missing Packages

• Wellness Body Worx is not responsible for lost, stolen, or missing packages once tracking shows the package as delivered.
• Customers must:
  • Check with household members, neighbors, or building management
  • Verify the delivery address and any safe drop locations
  • Contact the shipping carrier directly to file a lost package claim
• We may assist by providing order details, tracking information, or proof of shipment at our discretion, but we are under no obligation to issue refunds or replacements for carrier-related losses.
• Package theft (porch piracy) is not covered by Wellness Body Worx and must be reported to local authorities.

9. Delivery Delays

• Delivery delays do not entitle customers to refunds, returns, credits, or chargebacks.
• Carrier delays, including but not limited to weather events, high volume periods, or routing errors, are outside our control and do not constitute a breach of contract or failure to deliver.
• Customers who require delivery by a specific date should contact us in advance to discuss expedited options, though we cannot guarantee delivery by any specific date.

10. Damaged Shipments

• If an order arrives with visible external damage to the shipping box, customers must:
  • Refuse delivery or note damage with the carrier at the time of delivery, if possible
  • Contact us within 48 hours of delivery with:
    • Order number
    • Photos of the damaged product(s)
    • Photos of all sides of the shipping box
    • Photos of internal packaging materials
• Failure to report damage within 48 hours voids eligibility for review.
• Any resolution—including replacement, partial refund, store credit, or referral to the product manufacturer—is determined at our sole discretion based on investigation and available evidence.
• Damage claims may be denied if:
  • Proper documentation is not provided
  • Evidence suggests misuse, mishandling after delivery, or customer-caused damage
  • The carrier's investigation determines no carrier fault

11. Refused, Unclaimed, or Returned-to-Sender Shipments

• Customers who refuse delivery or fail to claim packages (including those held at postal facilities) are not eligible for refunds.
• If a package is returned to us due to customer refusal, unclaimed status, or undeliverable address, the customer is responsible for:
  • All return shipping costs incurred
  • Any reshipment fees if reshipment is requested and approved
• Store credit, if issued, will be reduced by all applicable return shipping and restocking fees.

12. Tracking & Delivery Confirmation

• Tracking information will be provided via email once the order is shipped.
• Customers are responsible for monitoring tracking information and taking appropriate action if delivery issues arise.
• Delivery confirmation via carrier tracking is considered proof of delivery.
• Claims of non-delivery will not be honored if tracking shows the package was delivered to the address provided by the customer.

13. Signature Required Deliveries

• For high-value orders or at our discretion, we may require signature confirmation upon delivery.
• Customers who are unavailable to sign may need to arrange redelivery or pickup at a carrier facility.
• We are not responsible for delays caused by customer unavailability for signature-required deliveries.

14. Force Majeure

• Wellness Body Worx is not liable for any failure or delay in fulfillment, shipping, or delivery caused by events beyond our reasonable control, including but not limited to:
  • Acts of God (earthquakes, floods, fires, storms, etc.)
  • War, terrorism, civil unrest, or government actions
  • Labour disputes, strikes, or lockouts
  • Pandemics, epidemics, or public health emergencies
  • Supplier failures, material shortages, or supply chain disruptions
  • Utility failures, telecommunications outages, or cyberattacks
  • Carrier service interruptions or systemic failures
• In the event of force majeure, we reserve the right to cancel orders, extend processing times, or suspend shipping operations without liability.

15. Chargebacks & Dispute Resolution

• Customers agree to contact Wellness Body Worx directly before initiating any payment dispute, chargeback, or claim related to shipping issues.
• We will work in good faith to resolve legitimate concerns.
• Chargebacks filed without prior contact may be disputed using:
  • Order confirmation and payment records
  • Carrier tracking and delivery confirmation
  • Email correspondence and communication logs
  • This Shipping Policy as agreed to at checkout
• Unjustified chargebacks may result in account suspension and may be pursued for recovery of costs, including administrative fees and legal expenses.

16. Policy Modifications

• We reserve the right to modify, update, or replace this Shipping Policy at any time without prior notice.
• The policy in effect at the time of order placement governs that transaction.
• Continued use of our website or placement of orders after policy changes constitutes acceptance of the revised terms.
• It is the customer's responsibility to review this policy periodically.

17. Limitation of Liability

• To the fullest extent permitted by law, Wellness Body Worx's total liability for any shipping-related claim shall not exceed the original purchase price of the affected product(s), excluding shipping fees.
• We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from shipping delays, lost packages, or delivery issues.
• This includes but is not limited to lost profits, lost business opportunities, loss of data, or emotional distress.

18. Governing Law & Jurisdiction

• This Shipping Policy is governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
• Any disputes arising from this policy or related to shipping shall be resolved in the courts of Ontario, Canada.

19. Severability

• If any provision of this Shipping Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
